AppBricks Terms of Use

Effective Date

PLEASE READ THESE TERMS CAREFULLY.

These Terms of Use ("Terms") constitute a legally binding agreement between you and AppBricks ("AppBricks," "we," "us," or "our") governing your access to and use of our websites, applications, software, AI-powered features, and related services that link to these Terms (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you are using AppBricks on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not access or use the Service.


1. Eligibility and Accounts

1.1 Eligibility

You must be at least 13 years old to use the Service.

If you are under the age of majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

Some features may have additional age requirements under applicable law.

1.2 Account Registration

Certain features of AppBricks may require you to create an account.

You agree to:

  • Provide accurate and complete account information

  • Keep your information current

  • Maintain the confidentiality of your login credentials

  • Protect authentication methods associated with your account

  • Notify us promptly if you believe your account has been compromised

You are responsible for activity that occurs through your account unless caused directly by our failure to use reasonable security measures.

You may not impersonate another person or create an account using information you are not authorized to use.

1.3 Organization Accounts

Certain AppBricks features may allow accounts to be associated with businesses, organizations, teams, or workspaces ("Organizations").

If you use the Service through an Organization, the Organization may control aspects of your account and may be able to:

  • Manage your access

  • Access Organization-related data

  • Configure permissions

  • Add or remove users

  • Suspend or terminate your access

Information submitted through an Organization account may be controlled by that Organization.

Where applicable, the agreement between AppBricks and the Organization may govern the Organization's use of the Service in addition to these Terms.

1.4 Third-Party Accounts and Integrations

The Service may allow you to connect third-party services, applications, accounts, websites, APIs, platforms, or data sources.

By connecting a third-party service, you authorize AppBricks to access, transmit, receive, and process information from that service as reasonably necessary to provide the requested integration.

Third-party services are not controlled by AppBricks.

We are not responsible for:

  • Their availability

  • Their security practices

  • Their content

  • Their accuracy

  • Their privacy practices

  • Changes made by their operators

Your use of a third-party service remains subject to that third party's own terms and privacy policies.


2. Access to the Service

2.1 Limited License

Subject to these Terms, AppBricks grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Service for its intended purposes.

This license does not transfer ownership of AppBricks or any portion of the Service to you.

2.2 Restrictions

Unless expressly permitted by AppBricks or applicable law, you may not:

  • Sell, license, rent, lease, sublicense, distribute, or commercially exploit the Service

  • Copy or reproduce material portions of the Service

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service

  • Circumvent technical restrictions, rate limits, security mechanisms, or access controls

  • Access the Service through automated means except through interfaces expressly provided by us

  • Scrape, crawl, extract, or harvest data from the Service

  • Use the Service to create or train a substantially competing product through unauthorized extraction of the Service or its proprietary outputs

  • Misrepresent the source or ownership of AppBricks content

  • Remove proprietary notices

  • Interfere with the operation, performance, integrity, or security of the Service

  • Attempt to gain unauthorized access to AppBricks systems or another user's account

Nothing in these Terms restricts rights granted to you under mandatory applicable law that cannot legally be waived.

2.3 Changes to the Service

We may modify, update, replace, add, suspend, or discontinue features of the Service.

We may also impose or modify:

  • Usage limits

  • Storage limits

  • API limits

  • Feature restrictions

  • Supported integrations

  • Model availability

  • Subscription entitlements

We will provide notice where required by applicable law.

We do not guarantee that any particular feature or integration will remain available permanently.

2.4 Service Availability

We aim to provide reliable access to AppBricks, but we do not guarantee uninterrupted or error-free availability.

The Service may be unavailable because of:

  • Maintenance

  • Infrastructure failures

  • Third-party outages

  • Software defects

  • Security incidents

  • Internet disruptions

  • Events outside our reasonable control


3. Fees and Subscriptions

3.1 Paid Services

Some or all AppBricks features may require a paid subscription ("Subscription").

The applicable price, billing interval, features, and subscription terms will be displayed when you subscribe.

By purchasing a Subscription, you authorize AppBricks or its payment provider to charge the applicable fees and taxes.

3.2 Automatic Renewal

Unless otherwise stated at the time of purchase, Subscriptions automatically renew at the end of each billing period until canceled.

By purchasing an automatically renewing Subscription, you authorize recurring charges using your selected payment method.

3.3 Cancellation

You may cancel your Subscription through the method provided when you subscribed.

If you subscribed through a third-party platform such as the Apple App Store or Google Play, cancellation and subscription management must generally be completed through that platform.

Cancellation usually takes effect at the end of the current billing period.

You will generally retain access to paid features until the end of that period unless otherwise stated.

3.4 Refunds

Payments are non-refundable except:

  • Where required by applicable law

  • Where required by an applicable app-store policy

  • Where expressly stated otherwise at the time of purchase

Nothing in these Terms limits any mandatory refund or withdrawal rights available to consumers under applicable law.

3.5 Free Trials

We may offer free or discounted trial periods.

If a trial automatically converts into a paid Subscription, the applicable terms will be disclosed before the trial begins.

You must cancel before the applicable deadline if you do not wish to be charged.

3.6 Pricing Changes

We may change Subscription prices or features in the future.

Price changes will apply prospectively and we will provide notice where required by law.

3.7 Taxes

Prices may exclude taxes unless stated otherwise.

You are responsible for applicable taxes, duties, or similar governmental charges to the extent permitted by law.

3.8 Failed Payments

If a payment cannot be processed, we may:

  • Retry the payment

  • Restrict paid features

  • Suspend your Subscription

  • Terminate paid access

You remain responsible for amounts properly due under your Subscription.


4. User Content

4.1 Definition

"User Content" means information, materials, or content that you upload, submit, connect, transmit, generate, import, or otherwise make available through AppBricks.

Depending on the features you use, User Content may include:

  • Text

  • Prompts

  • Documents

  • Files

  • Images

  • URLs

  • Website content

  • Application data

  • Analytics information

  • Search data

  • Configuration information

  • API data

  • Connected-service data

  • Instructions

  • Feedback

  • Other content submitted to the Service

4.2 Ownership

You retain ownership of your User Content.

AppBricks does not acquire ownership of User Content merely because you upload or submit it to the Service.

You are responsible for ensuring that you have all necessary rights, licenses, consents, and permissions to submit and process User Content through AppBricks.

4.3 License to AppBricks

You grant AppBricks a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, display, modify, and otherwise use User Content solely as reasonably necessary to:

  • Provide the Service

  • Perform actions you request

  • Maintain and secure the Service

  • Troubleshoot technical issues

  • Comply with applicable law

  • Enforce these Terms

This license ends when the relevant User Content is deleted from our systems, subject to reasonable backup periods and legal retention requirements.

4.4 Responsibility for User Content

You are solely responsible for your User Content and the consequences of submitting, processing, publishing, or sharing it.

You represent that your User Content and use of the Service do not:

  • Violate applicable law

  • Infringe intellectual property rights

  • Violate privacy or publicity rights

  • Breach confidentiality obligations

  • Contain malicious software

  • Violate contractual restrictions applicable to you

4.5 Deletion

You may be able to delete User Content through the Service.

Deleted information may remain temporarily in:

  • Backups

  • Security logs

  • Fraud-prevention systems

  • Legal records

  • Disaster-recovery systems

We may retain information when required or permitted by law.

4.6 Sharing

Certain features may allow you to share User Content, generated results, dashboards, links, reports, or other information with third parties.

You are responsible for deciding whom you share information with.

We cannot guarantee that information you intentionally share with another person will remain private after that person receives it.


5. Acceptable Use

You agree not to use AppBricks to:

  • Violate any law or regulation

  • Infringe another person's intellectual property rights

  • Violate privacy or data-protection laws

  • Gain unauthorized access to systems, accounts, applications, or data

  • Circumvent authentication or security mechanisms

  • Distribute malware, ransomware, viruses, or other malicious code

  • Conduct fraudulent activity

  • Impersonate another individual or organization

  • Harass, threaten, exploit, or harm another person

  • Send unlawful spam or abusive automated traffic

  • Interfere with the Service or its infrastructure

  • Intentionally overload or disrupt AppBricks systems

  • Circumvent usage limits, billing mechanisms, or Subscription restrictions

  • Use stolen, unauthorized, or unlawfully obtained information

  • Use the Service in a manner that could create legal liability for AppBricks or other users

We may investigate suspected violations and may restrict, suspend, or terminate access when reasonably necessary.


6. Artificial Intelligence Features

6.1 AI-Generated Outputs

Certain features of AppBricks may use artificial intelligence or machine learning systems to generate:

  • Recommendations

  • Analysis

  • Reports

  • Summaries

  • Predictions

  • Scores

  • Search results

  • Suggested actions

  • Text

  • Other generated materials

These materials are referred to as "Outputs."

6.2 Accuracy

Artificial intelligence systems may generate Outputs that are:

  • Incorrect

  • Incomplete

  • Outdated

  • Misleading

  • Biased

  • Inappropriate

  • Similar to content provided to other users

You are responsible for reviewing Outputs before relying on them.

You should independently verify important information.

6.3 Human Judgment

AppBricks is designed to assist users, not replace professional judgment.

You remain responsible for decisions you make based on information provided by AppBricks.

6.4 No Professional Advice

Unless expressly stated otherwise, AppBricks does not provide:

  • Legal advice

  • Financial advice

  • Investment advice

  • Accounting advice

  • Medical advice

  • Tax advice

  • Compliance advice

You should consult an appropriate qualified professional where necessary.

6.5 Third-Party AI Providers

AppBricks may use third-party artificial intelligence providers to operate certain features.

Information submitted through AI-powered features may therefore be processed by those providers in accordance with our Privacy Policy and applicable agreements.


7. Data Use and Model Training

7.1 Privacy Policy

Our collection and processing of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.

7.2 Usage and Diagnostic Data

We may collect technical, usage, diagnostic, and performance information to:

  • Operate AppBricks

  • Maintain security

  • Understand product usage

  • Fix errors

  • Improve reliability

  • Develop features

7.3 Aggregated and De-Identified Information

We may create aggregated or de-identified information from information processed through the Service.

We may use such information for:

  • Analytics

  • Research

  • Product development

  • Performance measurement

  • Service improvement

Where information is de-identified, we will not intentionally attempt to re-identify it except where necessary to verify that de-identification measures remain effective or as otherwise permitted by law.

7.4 AI Model Training

Unless we clearly disclose otherwise or you separately agree, AppBricks will not use private User Content to train publicly available AI models operated by AppBricks.

Third-party AI providers may have their own data-processing practices. Where reasonably available, we seek to use business or API products configured so that customer content is not used to train those providers' publicly available models.

8. Intellectual Property

8.1 AppBricks Property

The Service, excluding User Content, including its:

  • Software

  • Code

  • Interfaces

  • Designs

  • Branding

  • Logos

  • Graphics

  • Models

  • Documentation

  • Databases

  • Features

  • Website

  • Content

is owned by AppBricks or its licensors and is protected by intellectual property laws.

Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

8.2 Feedback

If you provide ideas, recommendations, suggestions, or feedback regarding AppBricks ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free right to use that Feedback without restriction or compensation.

You should not submit Feedback that you consider confidential or proprietary.


9. Third-Party Services

The Service may contain links to, integrate with, or rely upon third-party services.

AppBricks does not control those services.

We do not guarantee:

  • Their availability

  • Their reliability

  • Their accuracy

  • Their security

  • Their continued compatibility with AppBricks

Your relationship with third-party providers is governed by their own terms.

We are not responsible for losses caused solely by third-party services to the extent permitted by applicable law.


10. Copyright and Intellectual Property Complaints

We respect intellectual property rights.

If you believe material available through AppBricks infringes your copyright or other intellectual property rights, please contact:

  • Identify the protected work

  • Identify the allegedly infringing material

  • Locate the relevant material

  • Contact you

  • Understand the basis of your claim

Where applicable, we may remove or disable access to allegedly infringing material and may suspend repeat infringers.


11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

APPBRICKS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • TITLE

  • NON-INFRINGEMENT

  • ACCURACY

  • RELIABILITY

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL ALWAYS BE AVAILABLE

  • THE SERVICE WILL BE ERROR-FREE

  • OUTPUTS WILL ALWAYS BE ACCURATE

  • ALL DEFECTS WILL BE CORRECTED

  • THE SERVICE WILL MEET EVERY USER'S REQUIREMENTS

  • DATA WILL NEVER BE LOST

  • THE SERVICE WILL BE COMPLETELY SECURE

NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LEGALLY BE EXCLUDED UNDER APPLICABLE CONSUMER LAW.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPBRICKS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SERVICE.

THIS INCLUDES, WHERE PERMITTED BY LAW:

  • LOST PROFITS

  • LOST REVENUE

  • LOST BUSINESS OPPORTUNITIES

  • LOST DATA

  • BUSINESS INTERRUPTION

  • LOSS OF GOODWILL

  • COST OF REPLACEMENT SERVICES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPBRICKS' TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID APPBRICKS DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR

  2. €100.

THE LIMITATIONS ABOVE DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

IN PARTICULAR, NOTHING IN THESE TERMS LIMITS LIABILITY WHERE SUCH LIMITATION WOULD BE PROHIBITED UNDER MANDATORY CONSUMER-PROTECTION LAW.


13. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless AppBricks and its affiliates, officers, directors, employees, contractors, and representatives from claims, liabilities, losses, damages, and reasonable costs arising from:

  • Your unlawful use of the Service

  • Your User Content

  • Your violation of these Terms

  • Your violation of another person's rights

  • Your violation of applicable law

This obligation does not apply to the extent a claim was caused by AppBricks itself.


14. Suspension and Termination

14.1 Suspension by AppBricks

We may restrict or suspend access to the Service if we reasonably believe:

  • You violated these Terms

  • Your activity creates a security risk

  • Your activity may be unlawful

  • Your activity could cause harm to AppBricks or another person

  • Your account has unpaid fees

  • Suspension is necessary to protect the Service

Where appropriate and legally required, we will provide reasonable notice.

14.2 Termination by You

You may stop using AppBricks at any time.

You may also delete your account where account-deletion functionality is available.

Deleting your account does not automatically cancel a Subscription purchased through Apple, Google, or another external billing platform. You must cancel through the relevant platform where applicable.

14.3 Effect of Termination

After termination:

  • Your right to use the Service ends

  • We may delete User Content associated with your account

  • Certain information may remain in backups or records

  • Payment obligations already incurred remain due

Sections that by their nature should survive termination will continue to apply.

These include provisions concerning:

  • Intellectual property

  • Disclaimers

  • Liability

  • Indemnification

  • Disputes

  • User Content rights already exercised

  • Governing law


15. Changes to These Terms

We may update these Terms from time to time.

When we do, we will update the Effective Date above.

If a change materially affects your rights, we may provide additional notice through:

  • Email

  • The Service

  • An in-app notice

  • Our website

Where required by applicable law, we will obtain your consent before material changes take effect.

Continued use of the Service after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.


16. Consumer Rights

If you are a consumer, you may have statutory rights under the laws of the country in which you reside.

Nothing in these Terms is intended to waive or restrict mandatory consumer rights that cannot legally be excluded.

For users located in the European Union, European Economic Area, or United Kingdom, mandatory consumer-protection rules of your country of residence may apply regardless of other provisions in these Terms.

17.1 Informal Resolution

Before initiating formal proceedings, you agree to make a reasonable effort to resolve disputes directly with us.

We will make reasonable efforts to respond.

17.2 Mandatory Consumer Rights

Nothing in this Section limits your right to use courts, consumer-protection procedures, regulators, or other dispute-resolution mechanisms where such rights cannot legally be waived.


18. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law principles.

If you are acting as a consumer and live in the European Union, this choice of law does not deprive you of mandatory consumer protections provided by the laws of your country of residence.

For disputes involving consumers, the jurisdiction rules provided by applicable mandatory law apply.

For business users, to the extent legally permitted, the courts at AppBricks' registered place of business shall have exclusive jurisdiction.


19. Electronic Communications

By using AppBricks, you consent to receiving electronic communications related to the Service.

These may include:

  • Account notifications

  • Verification messages

  • Security alerts

  • Billing notices

  • Subscription information

  • Product changes

  • Legal notices

  • Service announcements

We may communicate with you by email, in-app messages, or notifications through the Service.

You may unsubscribe from promotional communications where applicable, but you may continue receiving essential operational and transactional messages.


20. Export and Sanctions Compliance

You may not use the Service where doing so would violate applicable export-control, trade-control, or sanctions laws.

You represent that you are not prohibited from using the Service under laws applicable to you or AppBricks.


21. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent.

We may assign these Terms as part of:

  • A merger

  • Acquisition

  • Corporate restructuring

  • Sale of assets

  • Transfer of the AppBricks business

subject to applicable law.


22. Force Majeure

AppBricks is not responsible for delays or failures caused by circumstances reasonably outside our control, including:

  • Natural disasters

  • Internet outages

  • Government actions

  • War

  • Civil unrest

  • Labor disputes

  • Cyberattacks

  • Utility failures

  • Cloud-provider outages

  • Third-party infrastructure failures


23. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be modified or interpreted to the minimum extent necessary to make it enforceable where possible.

The remaining provisions remain in effect.


24. No Waiver

If AppBricks does not enforce a provision of these Terms immediately, that does not waive our right to enforce it later.


25. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms expressly incorporated into them, constitute the agreement between you and AppBricks regarding the Service.

They supersede prior agreements relating to the same subject matter unless otherwise expressly agreed in writing.
